A Glimpse into the Implementation of Judicial Pardon under Law Number 1 of 2023 on the Criminal Code

Law Number 1 of 2023 on the Criminal Code, which will come into effect on 2 January 2026, regulates, among other things, provisions related to Judicial Pardon. Judicial Pardon is a type of court judgment in which the court is of the opinion that the defendant is guilty of committing the criminal offenses as charged, but the court decides to pardon the defendant, and therefore does not impose a sentence on the defendant. As a judgment, there are several criteria for the imposition of a judicial pardon, such as the minor nature of the act, the personal circumstances of the offender, and the conditions at the time the criminal offense was committed and thereafter.
