The latest SOE Law introduces a fundamental shift in dispute resolution among state-owned enterprises by mandating mediation as the compulsory mechanism for resolving disputes within the SOE ecosystem, with the Minister of SOEs (or appointed officials) acting as mediator. This framework is intended to promote efficiency, strengthen synergy, and reduce legal fragmentation; however, it also raises practical challenges—particularly the need for highly capable mediators and clear implementation mechanisms—highlighting both the opportunities and complexities of enforcing a centralized, mediation-based dispute resolution system.
