AHRP Achieves Favorable Tax Court Decision in Customs Dispute for Government Project Contractor

AHRP successfully represented a contractor company engaged in a government project in a customs dispute before the Tax Court. The company had imported goods that were eligible for import tax facilities. The dispute arose due to an administrative error in fulfilling the required procedures, leading the customs authority to determine that the importation was ineligible for such facilities. Consequently, the imposition of import taxes was incurred.


Led by Partner Zaka Hadisupani Oemang and supported by Junior Partners Fadra Heryndra and M. Sakti H. Tambunan, along with Senior Associate M. Radhitya Hawari and Associate Tariq Hidayat Pangestu, the AHRP team successfully established before the Tax Court that, despite the procedural deficiencies, the importation remained substantively entitled to import tax facilities. Therefore, the judges fully granted our appeal and accordingly, the import tax facilities were applied.
