Corporate Criminal Liability: Clarity or Continued Ambiguity?

Indonesia now formally recognizes corporations as subjects of criminal law under Law Number 1 of 2023 as the new Indonesia Criminal Code. The framework adopts multiple approaches to liability, allowing corporations to be held accountable where offenses benefit the company, reflect corporate policy, or result from a failure to prevent wrongdoing. Sanctions range from fines to business closure and dissolution. However, the line between individual and corporate liability remains blurred, as attribution still relies heavily on individual conduct.
