In the midst of an unlimited global data stream, transnational cybercrimes that threaten the security of personal data and personal data breaches incidents have become a real threat, including for Indonesia. In facing these global challenges, Indonesia has enacted Law Number 27 of 2022 concerning Personal Data Protection. This regulation serves as the main legal foundation designed to comprehensively regulate all aspects of data protection. With the transition period ending and full enforcement in October 2024, the PDP Law becomes a central legal instrument expected to be at the forefront of protecting the data sovereignty of the people.

This legal brief presents an in-depth analysis of the effectiveness of this legal framework. We dissect how the PDP Law interacts with existing cyber regulations, test the strengths and weaknesses of its articles in a transnational context, and evaluate the practical implementation challenges after it comes into full effect in October 2024. Find out more our insights about this topic in our Legal Brief publication.
