Mechanism for Compensation of Losses Arising from Toll Road Incidents

On 20 May 2024, the Indonesian government enacted Government Regulation Number 23 of 2024 on Toll Roads, which revokes the previous Government Regulation Number 15 of 2005 ("GR 15/2005"). One of the key changes that has raised concern is the abolishment of the toll road business entity’s legal right to claim compensation from toll road users for losses resulting from unlawful acts, as previously regulated under Article 86 of GR 15/2005. This Legal Brief aims to provide a better understanding of how toll road business entities may still uphold their legal right to claim compensation from toll road users for losses caused by unlawful acts. Additionally, the perspective of toll road users in claiming compensation from toll road business entities is elaborated to illustrate the reciprocal nature of liability and compensation under the current regulatory framework.
